    About the Program:

    In times of economic anxiety, employers see a rise in the number of employee conflicts, misunderstandings and internal complaints.  HR Professionals are increasingly relied upon to investigate complex charges of harassment and other employee misconduct.  These investigations, which often afford little or no lead time, are difficult exercises in deception detection, complicated by challenging interpersonal dynamics and the ever-present threat of litigation. In addition, Title VII and other statutes regulating employee complaints require that employer investigations be conducted promptly, effectively, fairly and remedially.

    In this session, an experienced employment lawyer will outline the anatomy of an effective investigative protocol and identify real-life techniques used to distinguish truth from deception. This program will educate the HR professional about how to design, control and understand the elements of an effective investigative plan and process, documents to create and maintain, and best practices for achieving a fair outcome.

    About the Speakers:

    Misti Mukherjee is a Partner in Jackson Lewis LLP’s Washington, D.C. Region office.  Since entering private practice in 1991, Ms. Mukherjee has represented employers in a wide range of labor and employment law matters.

    Ms. Mukherjee partners with her clients to develop creative and strategic solutions on a wide range of employment law issues, including employment discrimination, corporate compliance and internal investigations, performance counseling, wage-hour law, discipline, termination, mass layoffs, family and medical leave, disability accommodation, defamation, COBRA, and Sarbanes-Oxley compliance.  She negotiates and drafts agreements related to executive employment, equity compensation, consulting, confidentiality, restrictive covenants, and severance.  She advises executive management, human resources professionals, and in-house counsel on the development, implementation, and enforcement of personnel policies and risk-management tools.  Ms. Mukherjee also is a sought-after trainer of human resources professionals, executives, and line managers regarding best practices and policies, and on compliance with the ever-changing landscape of employment laws.  Her clients include businesses, non-profit organizations, and trade associations.

    For the past two years, in 2010 and 2011, Ms. Mukherjee was named one of the “Top 25 Women Attorneys” in Virginia by Richmond Magazine.  Ms. Mukherjee was also named by Virginia Lawyer’s Media as one of the 2010 “50 Influential Women of Virginia.”  Every year since 2006, Ms. Mukherjee has been designated by Law and Politics magazine as a “Super Lawyer” for Employment & Labor Law in Virginia and Washington, D.C.  She has repeatedly been named to Virginia’s Labor and Employment “Legal Elite” by Virginia Business magazine, and in December 2008, she was a Virginia “Legal Elite” top-10 vote getter, statewide, in the labor and employment category.  In November 2008, she was recognized as a Washington, D.C. “Smart Lawyer” by Washington Smart CEO magazine.  Ms. Mukherjee is a frequent and popular speaker on the topics of employment law and human resources trends and developments to local HR and business associations.

    Ms. Mukherjee, who currently sits on the Board of Directors of Northern Virginia Family Service, has been a leader in many other professional and community organizations, including the Executive Women’s Roundtable, Inc., the HR Leadership Forum, and the CARE (Companies as Responsive Employers) Awards Advisory Board.  She has twice served as a Judge for the HR Leadership Awards of Greater Washington, she is a Past President of The Madeira School Alumnae Association, she is a recent Trustee of The Madeira School, and she serves on Marymount University’s Reston Campus Advisory Board.  She also sings soprano with the gospel choir, Mosaic Harmony.

    After graduating from the Honors Program at the University of Texas, Ms. Mukherjee received her Juris Doctor degree from the University of Texas Law School.

    John M. Remy is the Managing Partner of the Washington, D.C. Region office of Jackson Lewis LLP.  Under his management, the office has grown from 13 to over 30 lawyers.

    Mr. Remy’s practice focuses exclusively on labor and employment litigation and counseling.  With eight jury trials in the past seven years and three in 2011 alone, Mr. Remy is one of the preeminent employment defense litigators in the Washington, D.C. area.  He represents employers in federal and state court lawsuits covering a wide range of statutes and subjects, including federal and state anti-discrimination laws, whistleblower and wrongful termination claims, wage and hour laws, covenants not to compete, breach of duty of loyalty, and breach of contract.  Mr. Remy also has extensive experience litigating class and collective actions, including nationwide FLSA collective actions and nationwide race discrimination and disability discrimination class actions.

    As part of his counseling practice, Mr. Remy provides daily advice and training to management to help employers avoid litigation.  His traditional labor experience includes handling representation cases and numerous clarification petitions, unfair labor practice cases, and labor arbitrations.  He represents employers before the Equal Employment Opportunity Commission, National Labor Relations Board, Department of Labor, and numerous state and local agencies.

    Mr. Remy has been named a “Super Lawyer” by Virginia Super Lawyers and D.C. Super Lawyers magazines, one of the D.C. area’s “go to” SmartLawyers, a member of the “Legal Elite” by SmartCEO magazine, and one of Virginia’s “Legal Elite” by Virginia Business Magazine.  He is a frequent speaker before human resource organizations, industry associations, and similar groups.  He is a member of the Virginia, Maryland, and District of Columbia Bars.

    Mr. Remy received his undergraduate degree magna cum laude from Northwestern University.  He earned his J.D., with honors, from the University of Michigan Law School.  He is a member of the Board of Directors for Habitat for Humanity of Northern Virginia and lives in Vienna, Virginia, with his wife and four children.
